Terms, in plain English.

These are the rules for using the site. We've kept them short. By using birthdaydeals.com.au you agree to them — but there's nothing surprising in here.

01Agreement

By accessing or using Birthday Deals Australia (the "Site") you agree to these Terms of Use. If you don't agree, please don't use the Site.

These Terms together with our Privacy Policy form the whole agreement between you and us regarding the Site.

02What the site is

Birthday Deals Australia is an independently-edited directory of birthday loyalty programs, freebies, and offers from Australian businesses. We do not operate those programs and we are not a party to any offer you claim.

We point you at the door. The brand decides whether to let you in, what to give you, and on what terms.

03Accuracy of listings

We do our best to keep the directory current, but we don't independently verify offers. Loyalty programs change their terms, vary by location, and occasionally disappear without warning. The listing on the Site is a pointer — always read the brand's own current terms before relying on any specific offer.

If a deal you saw on the Site isn't honoured, that's between you and the brand. Please tell us anyway — we'll update the listing.

04Acceptable use

You agree not to:

  • Scrape, mirror, or republish the directory wholesale (a single offer for personal reference is fine).
  • Use automated tools to extract content at a rate that imposes an unreasonable load.
  • Misrepresent yourself to any listed brand using information from the Site.
  • Use the Site for anything illegal, fraudulent, or to harm others.
  • Interfere with the Site's operation, security, or other users' experience.

05Accounts and saved data

We don't require accounts. Anything you save — favourited deals, or a birthday date and reminder settings for notifications — is stored in your own browser using localStorage. Clear your browser data and it's gone. We have no way to recover it.

06Intellectual property

Our editorial content — written descriptions, articles, the site design, illustrations, and the organisation of the directory itself — is © Birthday Deals Australia. You may quote short passages with attribution and a link back. You may not republish in full.

Brand names, logos, and trade marks belong to their respective owners and appear under nominative fair use to describe each brand's offer. No endorsement, sponsorship, or affiliation is implied.

07Third-party brands and offers

When you click through to a brand's website, you leave the Site and are subject to that brand's own terms and privacy policy. We are not responsible for their content, conduct, or honouring (or not) of any offer.

08Disclaimer of warranties

The Site is provided "as is" and "as available". To the maximum extent permitted by law we make no warranties, express or implied, about the Site's accuracy, completeness, fitness for any particular purpose, or uninterrupted availability.

09Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising from your use of the Site, including (without limitation) lost time, missed offers, or any dispute between you and a third-party brand.

Where liability cannot be excluded, our total aggregate liability is limited to AUD 100.

10Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law that cannot be lawfully excluded.

If a guarantee under the Australian Consumer Law applies and we breach it, our liability is limited (where the law allows) to re-supplying the relevant service or paying the cost of re-supply.

11Termination

We may suspend or restrict access to the Site for anyone breaching these Terms, or for any reason at our discretion, with or without notice. You can stop using the Site at any time — there is nothing to cancel.

12Governing law

These Terms are governed by the laws of the State of Victoria, Australia. Any dispute will be dealt with by the courts of Victoria, and you and we submit to their non-exclusive jurisdiction.

13Changes

We may update these Terms. When we do, we'll change the Last reviewed date and, for material changes, mention it in the newsletter. Continuing to use the Site after a change means you accept the new version.
